1. Introduction
Welcome to the Borneo Twitchers Tours and Travel Sdn Bhd website (“Website”). This Website is operated by Borneo Twitchers Tours and Travel Sdn Bhd (Company Registration Number: RC30000326), a registered travel operator in Brunei Darussalam.

These Terms and Conditions (“Terms”) govern your access to and use of our Website and the services we offer. By accessing, browsing, or using our Website, and by making a booking with us, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Definitions

  • “We”, “Us”, “Our”, “the Company” refers to Borneo Twitchers Tours and Travel Sdn Bhd.
  • “You”, “Your”, “Client”, “Customer” refers to the user of the Website and/or the person making the booking.
  • “Services” refers to the tour packages, itineraries, accommodation, transport, guide services, and other travel-related products offered on this Website.
  • “Booking” refers to the reservation made by you for our Services.

3. Booking Terms & Conditions
3.1. Booking Process
A booking is considered confirmed once:
a) You have completed our online booking form or provided clear written confirmation via email or DM requests.
b) You have paid the required deposit or full payment as specified at the time of booking.
c) We have issued a written booking confirmation invoice.

3.2. Pricing and Inclusions

  • All prices are quoted in Brunei Dollars (BND) unless otherwise stated.
  • Prices are subject to change without notice until a booking is confirmed. This is due to potential fluctuations in exchange rates, fuel surcharges, taxes, and airfares.
  • The confirmation invoice will detail exactly what is included (e.g., accommodation, meals, transport, guide fees, entrance fees) and excluded (e.g., international flights, travel insurance, personal expenses, tips) in the price.

3.3. Payments

  • A full payment is required to secure your booking.
  • The full balance must be paid at least 7 days before the tour departure date.
  • Failure to pay the balance by the due date may be treated as a cancellation by you, and our cancellation policy will apply.

Accepted Payment Methods:

  • Online Card Payments: We accept online payments via Visa and Mastercard only through Pocket. All online card payments are processed through Pocket and are subject to a 3.5% processing fee. 
  • Bank Transfer: Payment can be made via direct bank transfer to our company account. Details will be provided on the invoice.
  • Cash Payment: Cash payments are accepted at our office during business hours. We accept Brunei Dollars (BND) and Singapore Dollars (SGD). Please note that for SGD cash payments, we do not accept the SGD $1 coin.

3.4. Cancellation by the Client
All cancellations must be received by us in writing. The cancellation will be effective from the date we receive the written notice. Cancellation charges apply as follows:

  • 80% of the total tour cost if the cancellation is made less than 3 days before the tour date.

3.5. Cancellation or Modification by Us

  • We reserve the right to cancel or modify a tour due to unforeseen circumstances beyond our control (Force Majeure), such as natural disasters, political instability, extreme weather, or insufficient numbers.
  • In such an event, we will offer you the choice of:
    Conducting the same tour on a different date with no additional charge.
  • We are not liable for any additional expenses incurred by you (e.g., visa fees, vaccinations, non-refundable flights).

4. Client Responsibilities

  • Travel Insurance: All clients must purchase comprehensive travel insurance that covers medical expenses, personal accident, repatriation, cancellation, curtailment, and personal liability. Proof of insurance may be requested.
  • Travel Documents: You are responsible for ensuring you have a valid passport, necessary visas, vaccinations, and other required travel documents for your itinerary. Requirements for visiting Brunei and other destinations on your tour must be checked by you.
  • Health & Fitness: Our tours, particularly birdwatching and wildlife tours, may require a reasonable level of fitness. You are responsible for assessing your suitability for the tour. You must inform us of any pre-existing medical conditions or disabilities at the time of booking.
  • Conduct: You are expected to behave in a manner that is respectful to fellow travellers, our guides, local communities, and the environment. We reserve the right to terminate your tour without refund if your behaviour is deemed unsafe, disruptive, or illegal.
  • No smoking: During the tours, you are not allowed to smoke or vape or shisha.

5. Liability

  • Borneo Twitchers Tours and Travel Sdn Bhd acts as an intermediary between you and the suppliers of the services (hotels, transport operators, etc.).
  • We exercise all reasonable care in selecting competent and reliable suppliers. However, we cannot be held liable for any loss, damage, injury, accident, delay, or irregularity that may occur due to the acts or omissions of these third-party suppliers.
  • We are not liable for any Force Majeure events as described in Clause 3.5.
  • Our liability for any claim, regardless of the form of action, shall be limited to the total amount paid for the tour.

6. Privacy Policy
Your privacy is important to us. Please refer to our separate Privacy Policy, which explains how we collect, use, and protect your personal information in compliance with Brunei’s laws. By using this site, you consent to such processing.

7. Intellectual Property
All content on this Website (including text, graphics, logos, images, itineraries, and tour descriptions) is the property of Borneo Twitchers Tours and Travel Sdn Bhd or its content suppliers and is protected by copyright laws. You may not reproduce, distribute, or use any content without our prior written permission. Failure to do so is grounds for litigation under the Brunei Darussalam Law.

8. Website Use

  • You agree to use this Website only for lawful purposes.
  • The content on this Website is provided for general information only. While we strive for accuracy, we do not warrant that the information is complete, accurate, or current.

9. Complaints
If you have a complaint during your tour, you must immediately inform your tour guide or our local representative to allow them the opportunity to resolve it. If the issue is not resolved, you must notify us in writing within 30 days of the completion of your tour.

10. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of Brunei Darussalam. Any disputes shall be subject to the exclusive jurisdiction of the courts of Brunei Darussalam.
